1. Introduction

Welcome to Exposed Photography. By accessing or using our website, purchasing products, or booking photography services, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

2. Intellectual Property & Copyright

All images, artwork, text, graphics, and content displayed on this website are the exclusive property of Exposed Photography unless otherwise stated.

  • You may not copy, reproduce, distribute, or use any material for commercial purposes without prior written consent.

  • Purchasing a print or artwork does not transfer copyright or reproduction rights.

  • Clients who commission photography services may receive limited usage rights for personal or agreed commercial purposes, as specified in their service agreement or invoice.

3. Products and Services

Exposed Photography offers:

  • Original photographic prints, framed artworks, and related merchandise available for purchase online.

  • Photography services, including commissioned shoots, exhibitions, and image licensing.
    We reserve the right to update, modify, or discontinue products or services at any time without prior notice.

4. Pricing & Payment

  • All prices are listed in South African Rand (ZAR) and include VAT where applicable.

  • Payments may be made securely via PayFast, EFT, or other approved payment gateways displayed at checkout.

  • Orders are processed once full payment has been received and confirmed.

  • Exposed Photography reserves the right to cancel any order if payment is not received, or if fraudulent activity is suspected.

5. Delivery & Shipping

  • We deliver locally within South Africa and internationally.

  • Local deliveries are handled via OMMS Couriers (Cape Town) or other trusted partners.

  • Delivery times vary depending on location and product type but typically range between 5–14 working days for local orders and 10–21 working days for international orders.

  • Customers will receive tracking details once an order has been shipped.

  • Exposed Photography is not liable for delays caused by courier services, customs, or factors beyond our control.

6. Returns, Refunds & Damages

  • Each artwork and print is made to order; therefore, returns and refunds are not accepted unless the item arrives damaged or defective.

  • In the case of damage during delivery, please notify us within 7 days of receiving your order with photos of the damage.

  • Once verified, we will arrange a replacement or refund at our discretion.

  • Refunds will only be processed back to the original payment method used.

7. Customer Information & Privacy

  • Personal details collected during checkout (name, address, contact number, email, payment information) are used solely for order processing, delivery, and communication.

  • We do not store or share payment card details.

  • Exposed Photography will never sell or distribute your personal information to third parties, except as required for order fulfilment or by law.

8. Service Bookings & Cancellations

  • Photography services are confirmed only upon receipt of a booking deposit or full payment.

  • Cancellation of a service booking must be made in writing. Deposits are non-refundable if cancellation occurs within 7 days of the scheduled date.

  • Any rescheduling requests will be accommodated where possible but are subject to availability.

9. Liability Disclaimer

  • While every effort is made to ensure the quality and accuracy of our products and services, Exposed Photography shall not be held liable for any indirect, incidental, or consequential loss arising from the use of our website or products.

  • All images are intended for visual representation only. Slight variations in color or texture may occur between screen previews and final printed products.

10. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
